Welcome to Pop Underwear! “We”, “us”, and “our” mean Pop Underwear. We operate this shop and website, including all related information, content, features, tools, products, and services to provide you with a personalized shopping experience (the “Services”). Our shop is powered by Shopify, which enables us to provide the Services.
The terms below, together with any related policies (the “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
SECTION 1 – ACCESS & ACCOUNT
By accepting these Terms, you represent you are of the age of majority in your place of residence and you authorize any minor under your care to use the Services on devices you own or manage.
To use the Services (browse, purchase, etc.), you may need to provide certain information (email, billing, payment, shipping). You represent and warrant this information is accurate, current, complete, and that you have the right to provide it.
You are solely responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell, assign, or license your account.

We strive to represent products and services accurately. However, colors and appearance may vary based on your device and settings.
We do not guarantee that appearance or quality will meet your expectations. Product descriptions may change at any time without notice. We may remove products or limit quantities per person, region, or jurisdiction.
SECTION 3 – ORDERS
Placing an order constitutes an offer to buy. Pop Underwear may accept or reject your order at its discretion. Orders are accepted only after confirmation and payment processing. Review your order carefully before submitting. If we reject, modify, or cancel an order, we will attempt to notify you using the contact details provided.
Returns/exchanges are only allowed per our Refund Policy [LINK]. You represent purchases are for personal/household use and not for resale or export.
SECTION 4 – PRICING & BILLING
Prices, discounts, and promotions may change without notice. The price charged is the one in effect when you place the order and appears in your confirmation email. Unless stated otherwise, prices exclude taxes, shipping/handling, and duties/imports.
Online prices may differ from those offered elsewhere. Some promotions may be governed by separate terms; in case of conflict, those terms control.
You agree to provide accurate, current purchase and payment information and to update it promptly (email, cards, expirations). You warrant you are authorized to use the payment method and agree to pay all amounts due, including applicable fees and taxes.
SECTION 5 – SHIPPING & DELIVERY
Shipping times are estimates only. We are not responsible for delays (carriers, customs, external events). Title and risk of loss pass to you when we hand products to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY
The Services (marks, text, images, video, audio, design, etc.) are owned by Pop Underwear, its affiliates, or licensors and are protected by law. You may use the Services for personal, non-commercial purposes only. Unauthorized use is prohibited. No license is granted unless expressly stated.
Pop Underwear names, logos, product/service names, designs, and slogans are trademarks of Pop Underwear or its affiliates/licensors. Do not use them without written permission. Shopify’s marks belong to Shopify. Other marks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
Third-party tools may be available “as is” and “as available,” without warranties or endorsement. Use is at your own risk and requires acceptance of the third party’s terms. Future features may be added and are subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may include third-party content/links. Accessing them is at your own risk. We are not responsible for any harm related to such sites, products, or services. Review their policies before transacting.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Our shop is powered by Shopify, but your purchases are with Pop Underwear. Shopify is not responsible for sales between you and Pop Underwear. You expressly release Shopify and its affiliates from liability arising from such purchases.
SECTION 10 – PRIVACY POLICY
Personal information collected via the Services is subject to our Privacy Policy and, for some data, Shopify’s privacy policy (see here). Data may be shared with Shopify and third parties (including abroad) to provide and improve the Services.
SECTION 11 – FEEDBACK
By submitting ideas/reviews (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose. You warrant you have the necessary rights and comply with these Terms. We may moderate/remove non-compliant Feedback without obligation.
SECTION 12 – ERRORS, INACCURACIES & OMISSIONS
Information on/in the Services may contain errors or omissions (descriptions, prices, promotions, timelines, availability). We may correct/update or cancel orders at any time, including after submission.
SECTION 13 – PROHIBITED USES
Use the Services only for lawful purposes. Prohibited uses include: illegal/malicious activity; violating laws; infringing IP; harassment/defamation; misleading information; unsolicited advertising/spam; impersonation; transmitting malicious code; collecting others’ personal data; circumventing security. We may suspend/terminate your account for violations.
SECTION 14 – TERMINATION
We may terminate your access at any time without notice. Sections that by nature should survive will continue to apply.
SECTION 15 – DISCLAIMER OF WARRANTIES
The Services and products provided through the Services are offered “as is” and “as available,” without express or implied warranties to the extent permitted by law.

You agree to indemnify Pop Underwear, Shopify, and their affiliates against third-party claims arising from your breach of these Terms, of law, or your use of the Services.

If any provision is invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Failure to enforce any right is not a waiver. These Terms and our posted policies constitute the entire agreement between you and us.
SECTION 20 – ASSIGNMENT
You may not assign your rights/obligations without our prior written consent. We may assign ours without your consent.
SECTION 21 – GOVERNING LAW
These Terms and any separate agreement are governed by the courts of the jurisdiction where Pop Underwear is headquartered. You and Pop Underwear submit to those courts.
SECTION 22 – HEADINGS
Headings are for convenience only and do not affect interpretation.

You can review the most current Terms on this page. We may update/modify/replace any part by posting updates. For material changes, we will notify you as required by law. Continued use constitutes acceptance.
